In Spain, surrogacy is not legal as the biological mother's renouncement contract is not legally binding or enforceable under Spanish law. Despite this, it is legal to perform the surrogacy in a different country where surrogacy laws allow for the creation of these contractual obligations. This is as long as the nationality of the biological mother is the same to that of the country where surrogacy is allowed.
